I am of legal age, in the country and state of my residency to enter this agreement.
This Application and Agreement shall constitute a binding agreement between "Eonconnect Hospedaje y Servicios de TI" (furtherly named Eonconnect) and myself at such time as this application is received and approved by Eonconnect's headquarter.

I MAY CANCEL THIS AGREEMENT AT ANYTIME EFFECTIVE UPON WRITTEN NOTICE TO Eonconnect with no expectancy of refund of any kind. There is a no contract to all of our hosting service plans. All setup fees are non refundable unless advertised as refundable. Eonconnect may immediately terminate a member who discredits the company’s name, misuses, misrepresents or violates any requirement contained in this Agreement, Polices and Procedures.

Eonconnect reserves the right to revise our policies at any time. Additionally, Eonconnect reserves the right to discontinue service for any account that we determine is being inappropriately or unlawfully used, and reserves the right to refuse service at our discretion.

Eonconnect reserves the right to revise our reseller commission pay rate at any time.
Web site construction and management is the responsibility of the client. Eonconnect is not responsible for web site management or files lost or damaged by users. Backup of all site files is recommended, and should be maintained by the client on a machine outside of the Eonconnect network. A fee of $30 is required should a client request any files from our back up systems, which are intended for disaster retrieval only. Eonconnect does not guarantee that the files contained in our backup systems will be the most current copy of a client's web site. Eonconnect will exclude the following file types in our backup system: (*.swf, *.zip, *.exe, *.mp3, *.mp4, *.mpg, *.wma, *.wmv, *.mov, *.avi, *.wav, *.gzip, *.tar, *.log, *.gz, *.iso, *.rar, *.psd)

If an account is used unlawfully or is in violation of the user policy, Eonconnect reserves the right to terminate the account without notice and without refunds. Files that violate the user policy are subject to deletion without notice. Clients violating the user policy will be held responsible for damages to Eonconnect, including but not limited to, Eonconnect's systems, servers, connectivity, reputation, business, service, network, operations, or equipment. Determining what constitutes a policy violation is the sole discretion of Eonconnect, and includes, but is not limited to, the following:

* AntiSpam Policy - Eonconnect strictly prohibits members from sending unsolicited mass emails or Spam, whether via email, Usenet or any other form. Any member using spamming techniques for soliciting referrals will be immediately terminated. In addition, their mailing address will be ineligible for opening a new membership account.

* Software/Multimedia Distribution - Accounts cannot to be used to distribute "cracked" versions of copyrighted software (a.k.a. warez), serial numbers for copyrighted software or copyrighted multimedia files (i.e. music files or MP3's). Sites that contain links to pirated software or illegal contraband are also prohibited.

* Adult Content - Sites containing adult material, links to adult material, or adult-oriented merchandise are not allowed by Eonconnect and any content found which relates to this type of material will be deleted without warning.

* System Abuse - Includes, but is not limited to, excessive use of CPU resources or disk space, installing IRC bots, excessive use of resources leading to the decrease of the system's performance or other CGI scripts that use a disproportionate amount of system resources. Eonconnect will determine what constitutes system abuse.

* Security Violation - Attempts to manipulate Eonconnect servers or client web sites are prohibited. This includes, but is not limited to, attempting to gain unauthorized access to Eonconnect servers, mail bombing, or other means of deliberately overloading systems.

* Gaming Servers and Mass Files Sharing Sites and Public FTPs and Proxy Web Browser are prohibited from all of our shared hosting plans. The final determination of what constitutes "Gaming Server" and "Mass Files Sharing Site" is made by Eonconnect.

* Storage Type - Using Eonconnect's web server as any kind of Mass File Storage and Backup Storage and Mass Video/Media Storage is prohibited on all of our shared hosting plans. The final determination of what constitutes "Mass File Storage" and "Backup Storage" and "Mass Video/Media Storage" is made by Eonconnect.

* Mass Media Sharing - Using Eonconnect's web server as any kind of Mass Video/Media download, sharing and streaming is prohibited on all of our shared hosting plans. The final determination of what constitutes "Mass Media Sharing" is made by Eonconnect.

* Unlimited Resource Usage - Eonconnect's services offer the unlimited resource usage at a normal (Normal is understood and deteermined by Eonconnect) rate consumption for a shared environment, if any one client exceeds the limits set for the server by itself, then they would incur in the respective charges based on the fact that if they are exceeding either 250GB of disk space or 2TB of bandwidth transfer they are lawfully responsible for any charges result of these consumption, in this case Eonconnect is responsible of letting the client know about this situation in case some discrepancies arise based on the historical usage of the site and understanding that those situations exceeding such limits immediately fall under a dedicated server environment.

Support:
* Eonconnect hosting services provide support through its forum and control panel ticketing system with a 24 hours time response for non critical situations.

* Eonconnect has a telephone number with a 24/7 site's emergencies extension for the following situations:
- Your site is down or unresponsive
- You can no longer receive e-mail
- You can not access your site via FTP and it is crucial to get it back at that moment

* If none of these previous situations is the one that you are experiencing and you call the emergencies extension, you accept to get charged $30 for bad use of this resource.

Setup and service fees are required to activate your hosting account with Eonconnect. Setup fees are non-refundable.
All shared hosting plans canceled within 15 days will receive a full refund on the hosting fee.

Eonconnect web site properties may contain technical inaccuracies or typographical errors. Changes to the Eonconnect web site properties may be made periodically. Every good faith effort will be made to keep the web site content accurate and up to date. Eonconnect reserves the right to make improvements and/or change our web site aand these terms and conditions at any time without notice.

USE OF Eonconnect WEB HOSTING SERVICES ARE AT THE CLIENT'S SOLE RISK. Eonconnect SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. Neither Eonconnect, its employees, affiliates, third party services, merchant licensors or the like, warrant that Eonconnect web hosting service will not be interrupted or error free. Eonconnect will make every good faith effort to ensure that its servers are available to as many Internet users as possible and that there is minimal interruption of service as possible.

Under no circumstance will Eonconnect, its partners, its employees, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use Eonconnect service, from service interruptions, from Eonconnect errors, from customer errors or problems with their Internet connectivity, from the client's equipment or available technology, from unauthorized access to Eonconnect servers, from communication failure, from bandwidth congestion or interruptions, loss of data, from any type of configuration error, or from acts of God.

Eonconnect assures the existance of the files in its servers for at least 1 month after the cancellation of service after which Eonconnect has the total right to delete the sites and everything related to that site without any Warning.

There will be a $10 process fee to re-active an expired or canceled hosting account.
All the previous statements apply in the same way for our Dedicated Server services.
This Agreement is not effective until accepted by Eonconnect.
